Skilled Employer Sponsored Regional (Provisional) visa

This visa enables regional employers to address identified labour shortages within their region by sponsoring skilled workers where employers can't source an appropriately skilled Australian worker

This visa allows regional employers to fill job vacancies by employing skilled workers from outside Australia when suitable Australian workers can’t be sourced.

 

Two streams:

  • Employer Sponsored Stream: Targets those nominated by an Australian employer.
  • Labour Agreement Stream: For those nominated by employers who have a Labour Agreement with the Australian Government.

 

Key Benefits:

  • Live, work, and study in designated regional Australia for 5 years.
  • Unlimited travel to/from Australia while the visa is valid.
  • Opportunity to apply for permanent residence after 3 years.

 

Eligibility Criteria:

  • Nomination in an eligible occupation.
  • Minimum 3 years of relevant work experience.
  • Relevant skills assessment (some exemptions apply).
  • Meet English proficiency requirements.
  • Work only for your nominating employer in regional Australia.
  • Must be under 45 years of age.
  • Health and character requirements must be met.

 

Obligations:

  • Start employment within 90 days of visa grant or upon entering Australia.
  • Work only in the nominated occupation and for the nominating regional employer.
  • Abide by all Australian laws.

 

Family Considerations:

  • Include family members in the application.
  • Family members must meet health and character requirements.
  • Specify reasons if not including partner or dependent children in the application.

 

Designated Regional Areas:

Excludes Sydney, Melbourne, and Brisbane.

 

Visa Costs:

  • Main Applicant: AUD4,045
  • Dependent (18+): AUD2,025
  • Dependent (under 18): AUD1,010
  • Additional charges may apply.

 

Application Process:

  • Applications assessed individually.
  • Ensure the application is complete and accurate to avoid delays.
  • Visa linked digitally to the passport.

 

Key Visa Conditions:

  • Inform changes in personal and employment details promptly.
  • Reside in a designated regional area.
  • Cooperate with any requests from the Australian Government.

 

Understanding Work Rights:

The Department collaborates with the Fair Work Ombudsman to promote understanding and adherence to Australian Workplace laws.

If you receive a letter from us, it may request your attendance for an interview. This interview might be in-person at a specified location, or it could be conducted via phone or online platforms. Make sure to check the letter for details regarding the date, time, and location/method of the interview.

 

8608– Understanding Your Occupation & Work Rights

  • You must strictly adhere to the occupation specified in your latest Subclass 494 (Skilled Employer Sponsored Regional (Provisional)) visa application.
  • You’re not allowed to switch occupations unless you apply and are granted a new Skilled Employer Sponsored Regional (Provisional) visa.
  • After entering Australia or receiving your visa (depending on your location during visa approval), you have a 90-day window to begin your work.
  • Avoid taking breaks from work that last more than 90 consecutive days.
  • Typically, you should be employed by the business that nominated you, though some exemptions exist. If considering a change of employer, ensure that the new employer receives nomination approval first.

 

Licenses, Registrations, and Memberships:

  • Some jobs require specific licenses, registrations, or memberships. Ensure you possess these if they’re mandatory for your occupation.
  • Refrain from working without these mandatory requirements, as it could be unlawful. If these are required, obtain them within 90 days, whether you were in Australia or abroad during your visa approval.
  • Promptly notify the Australian Government in writing if there are any issues with your license, registration, or membership.

The Department collaborates with the Fair Work Ombudsman to make certain that both employees and employers are informed about and comply with Australian workplace laws.
