Partner visa (Permanent)

This visa lets the de facto partner or spouse of an Australian citizen, Australian permanent resident or eligible New Zealand citizen live in Australia permanently. It is usually only for people who currently hold a temporary Partner visa (subclass 820).

This visa is for the spouse or partner of an Australian citizen, Australian Permanent Resident, or eligible New Zealand citizen. It lets you:

  • Live in Australia permanently.
  • Work or study freely.
  • Access Medicare, Australia’s healthcare scheme.
  • Bring certain family members to Australia.
  • Try for Australian citizenship after 4 years (if you meet the criteria).
  • Attend English classes provided by The Adult Migrant English Program (under certain conditions).

Stay Duration:

It’s a permanent visa. Your permanent status begins from the visa grant date.

Including Family: You can include your dependent children when applying. If a child wasn’t part of your earlier application, you can still add them before the final decision. They should be in Australia and have the required visa.

Eligibility:

  • You should currently have a subclass 820 (temporary) Partner visa.
  • Your relationship with your partner should be genuine. You either need to be legally married or in a de facto relationship for at least a year (exceptions may apply).
  • If you have any debt to the Australian Government, it needs to be settled.
  • Abide by Australian laws while on the temporary visa.

Cost:

Paid once for both temporary and permanent partner visas.

  • Main Applicant: $7,715
  • Additional Applicant (Child under 18): $1,935
  • Additional Applicant (Child over 18): $3,860

Application Process:

  • Combined Application: Apply for both the subclass 820 and 801 visas simultaneously.
  • 2-Year Review: Two years after applying, show that you still meet the visa requirements.
  • Bridging Visa: A bridging visa lets you stay in Australia while waiting for your 820 visa decision.

Processing Time:

22-26 months for the 801 visa. Duration can vary based on circumstances.

After Getting the 801 Visa: You should be in Australia when the visa is granted. The visa will be digitally linked to your passport.

If Visa is Refused: You can appeal to the AAT for a decision review. Be mindful of deadlines.

Visa Conditions: No specific conditions for the subclass 801 visa.
